前言

本协议是由林夏良（以下简称“许可人”或“我们”）与您（以下简称“用户”）之间，就使用“DJ 阿良”移动应用程序（以下简称“本应用”）所订立的法律协议。

1. 许可范围

  • 我们授予您一项有限的、不可转让的、非排他性的使用许可，允许您在您拥有或控制的设备上安装并使用本应用。
  • 本许可仅限于个人、非商业目的使用。

2. 音乐服务与第三方内容

  • 本应用目前通过 Apple Music Kit 提供音乐播放能力。您是否能够完整播放音乐，取决于您的 Apple Music 授权状态、订阅状态及 Apple 提供的服务可用性。
  • 本应用中涉及的歌曲、专辑封面、艺人名称及相关音乐内容，其知识产权归相关权利人所有，并不因在本应用中展示而转移给用户或许可人。
  • 本应用仅对歌单策划、内容组织、界面设计、品牌与软件本身享有相应权利。

3. 知识产权声明

  • 本应用的源代码、界面设计、视觉风格、产品名称“DJ 阿良”、歌单编排文案、场景分类方式及相关原创内容，均为林夏良的知识产权或依法享有的合法权益。
  • 未经书面许可，任何个人或组织不得以复制、传播、镜像、抓取、修改、反向工程、出租、出售、再许可、发布或其他方式侵犯本应用相关权利。
  • 本应用本身并不开源。除非我们明确书面说明，否则用户无权以开源、共享源码或二次分发的方式使用本应用。

4. 用户行为规范

  • 您不得使用本应用从事任何违反法律法规、公序良俗或侵害他人合法权益的行为。
  • 您不得利用本应用的内容、结构或数据接口进行批量抓取、镜像备份或未授权的自动化复制。
  • 您不得冒用本应用品牌、界面或内容向第三方提供仿制产品、服务或宣传材料。

5. 服务变更与中断

  • 我们有权根据产品需要对本应用进行更新、调整、维护或下线部分功能。
  • 若因 Apple Music 服务变更、网络故障、系统兼容性或其他第三方原因导致本应用部分功能受影响，我们不对由此产生的中断承担保证责任。

6. 免责声明

  • 本应用按“现状”和“可用状态”提供。
  • 我们不保证本应用在所有设备、网络环境或 Apple Music 服务状态下始终完全可用。
  • 在适用法律允许的最大范围内，我们不对因使用或无法使用本应用而导致的间接损失、附带损失或后果性损失承担责任。

7. 法律适用

本协议受中华人民共和国法律管辖。如因本协议产生争议，双方同意提交至开发者所在地有管辖权的人民法院解决。

  • 本應用中涉及的歌曲、專輯封面、藝人名稱及相關音樂內容，其知識產權歸相關權利人所有，並不因在本應用中展示而轉移給用戶或授權人。
  • 本應用僅對歌單策劃、內容組織、介面設計、品牌與軟體本身享有相應權利。

3. 知識產權聲明

  • 本應用的原始碼、介面設計、視覺風格、產品名稱「DJ 阿良」、歌單編排文案、場景分類方式及相關原創內容，均為林夏良的知識產權或依法享有的合法權益。
  • 未經書面許可，任何個人或組織不得以複製、傳播、鏡像、抓取、修改、逆向工程、出租、出售、再授權、發布或其他方式侵犯本應用相關權利。
  • 本應用本身並不開源。除非我們明確書面說明，否則用戶無權以開源、共享原始碼或二次分發的方式使用本應用。

4. 用戶行為規範

  • 您不得使用本應用從事任何違反法律法規、公序良俗或侵害他人合法權益的行為。
  • 您不得利用本應用的內容、結構或資料介面進行批量抓取、鏡像備份或未授權的自動化複製。
  • 您不得冒用本應用品牌、介面或內容向第三方提供仿製產品、服務或宣傳材料。

5. 服務變更與中斷

  • 我們有權根據產品需要對本應用進行更新、調整、維護或下線部分功能。
  • 若因 Apple Music 服務變更、網路故障、系統相容性或其他第三方原因導致本應用部分功能受影響，我們不對由此產生的中斷承擔保證責任。

6. 免責聲明

  • 本應用按「現狀」與「可用狀態」提供。
  • 我們不保證本應用在所有裝置、網路環境或 Apple Music 服務狀態下始終完全可用。
  • 在適用法律允許的最大範圍內，我們不對因使用或無法使用本應用而導致的間接損失、附帶損失或結果性損失承擔責任。

7. 法律適用

本協議受中華人民共和國法律管轄。如因本協議產生爭議，雙方同意提交至開發者所在地有管轄權的人民法院解決。

Introduction

This User License Agreement is a legal agreement between Matt Lin ("Licensor", "we", or "us") and you ("User") regarding your use of the DJ Liang mobile application (the "App").

1. Scope of License

  • We grant you a limited, non-transferable, non-exclusive license to install and use the App on devices that you own or control.
  • This license is granted for personal, non-commercial use only.

2. Music Services and Third-Party Content

  • The App currently uses Apple Music Kit for music playback. Whether full playback is available depends on your Apple Music authorization, subscription status, and the availability of Apple's services.
  • Songs, album artwork, artist names, and related music content displayed in the App remain the intellectual property of their respective rights holders and are not transferred to the User or Licensor by being shown in the App.
  • The App only claims rights in its playlist curation, content organization, interface design, branding, and software implementation.

3. Intellectual Property Notice

  • The App's source code, interface design, visual language, product name "DJ Liang", playlist editorial copy, scene classification approach, and related original materials are the intellectual property of Matt Lin or are otherwise lawfully owned or controlled by him.
  • Without prior written permission, no individual or organization may copy, distribute, mirror, scrape, modify, reverse engineer, rent, sell, sublicense, publish, or otherwise infringe upon any rights related to the App.
  • The App itself is not open source. Unless we expressly state otherwise in writing, you may not use the App in any open-source, source-sharing, or redistributable form.

4. Rules of Use

  • You may not use the App for any purpose that violates applicable laws, public order, good morals, or the lawful rights of others.
  • You may not use the App's content, structure, or data interfaces for bulk scraping, mirrored backups, or unauthorized automated copying.
  • You may not impersonate the App's brand, interface, or content to provide imitation products, services, or promotional materials to third parties.

5. Service Changes and Interruptions

  • We reserve the right to update, adjust, maintain, or remove parts of the App as needed for product development.
  • If parts of the App are affected by Apple Music service changes, network failures, system compatibility issues, or other third-party factors, we do not guarantee uninterrupted availability.

6. Disclaimer

  • The App is provided on an "as is" and "as available" basis.
  • We do not guarantee that the App will always be fully available across all devices, networks, or Apple Music service conditions.
  • To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising out of the use of, or inability to use, the App.

7. Governing Law

This Agreement is governed by the laws of the People's Republic of China. Any dispute arising from this Agreement shall be submitted to the court with jurisdiction in the developer's place of residence.
